1. Acceptance of Terms

By accessing and using PerchOps ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms form a legally binding agreement between you and Dovetail, the operator of PerchOps.

2. Description of Service

PerchOps provides AWS cloud security compliance monitoring, vulnerability assessment, and cost optimization services. The Service analyzes your AWS infrastructure to identify security issues and provide remediation guidance. Features include:

• Security vulnerability scanning and reporting
• Multi-framework compliance monitoring (CIS, PCI-DSS, HIPAA, and more)
• Cost optimization recommendations with one-click remediation
• AI-powered insights and automated remediation workflows

3. User Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Use the Service only for lawful purposes and in compliance with all applicable laws
• Provide accurate and complete information during registration
• Notify PerchOps immediately of any unauthorized use of your account
• Not attempt to circumvent or disable any security features of the Service

4. AWS Access and Permissions

To use PerchOps, you must grant the Service access to your AWS account via IAM roles. PerchOps uses this access solely for security analysis and cost monitoring. We offer two access modes:

• Read-Only: Scanning and monitoring only — no changes to your AWS resources
• Execution: Full access including auto-remediation and cost optimization actions

You remain in full control of which access mode to grant and may revoke access at any time by deleting the IAM role from your AWS account.

5. Data Privacy and Security

PerchOps collects and processes metadata about your AWS resources for security analysis. We do not access the content of your data stored in AWS services. All data is encrypted in transit (TLS 1.2+) and at rest (AES-256). For full details, see our Privacy Policy.

6. Trial License and Subscription

New users receive a 30-day free trial with full access to all features. No credit card is required to start a trial. After the trial period, you must purchase a subscription to continue using the Service. PerchOps reserves the right to modify pricing with 30 days' notice.

7. Intellectual Property

All content, features, and functionality of the Service — including but not limited to software, text, graphics, and logos — are the exclusive property of Dovetail and are protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without prior written consent.

8. Limitation of Liability

PerchOps provides security recommendations but does not guarantee complete security of your AWS infrastructure. You remain responsible for implementing security measures and remediations. To the maximum extent permitted by law, Dovetail shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

9. Termination

Either party may terminate this agreement at any time. PerchOps reserves the right to suspend or terminate your access if you violate these terms. Upon termination, your right to use the Service will immediately cease.

10. Changes to Terms

We may update these terms from time to time. We will notify you of significant changes via email or a notice on our platform. Continued use of the Service after changes constitutes acceptance of the updated terms.
